Terms of Service

These Terms govern the use of EnforceLayer and apply globally.

1. Service Provider

The Service is operated by:

("Provider", "we", "us")

2. Acceptance of Terms

By accessing or using EnforceLayer ("Service"), you agree to be bound by these Terms.

If you do not agree, you must not use the Service.

These Terms apply globally to all users regardless of jurisdiction.

3. Description of the Service

EnforceLayer provides:

  • DNS configuration analysis
  • Email authentication posture evaluation (SPF, DKIM, DMARC, BIMI)
  • Enforcement scoring
  • Configuration drift monitoring
  • Alerts and reporting tools

The Service is strictly an analytical and monitoring platform.

All outputs, reports, scores, and recommendations are advisory in nature.

We do not:

  • Modify DNS records
  • Operate email servers
  • Intercept email traffic
  • Guarantee inbox placement
  • Guarantee prevention of spoofing or cyber attacks
  • Provide legal or regulatory certification

4. Early Access / Service Phase

EnforceLayer operates in an early-stage release phase.

The Service focuses on:

  • Authentication correctness
  • DNS configuration visibility
  • Drift monitoring

Inbox placement and deliverability depend on many external factors including:

  • Sender reputation
  • Email content
  • Complaint rates
  • Mail provider policies

We do not guarantee inbox placement or full protection.

5. Advisory Nature & DNS Responsibility

All DNS recommendations are informational only.

You are solely responsible for:

  • Verifying all DNS recommendations
  • Backing up existing DNS configurations before applying changes
  • Ensuring compatibility with your email providers
  • Testing email functionality after modifications

If you are not confident in modifying DNS records, you must consult:

  • An IT professional
  • Your hosting provider
  • Your DNS administrator

You assume all risk associated with DNS modifications.

We are not responsible for:

  • Misconfiguration
  • Email outages
  • Service disruption
  • Financial losses
  • Business interruption
  • Reputation damage

6. No Guarantee of Security

Cybersecurity is inherently uncertain.

EnforceLayer analyzes publicly available DNS records only.

We do not:

  • Block attackers
  • Prevent all spoofing
  • Guarantee absence of fraud
  • Guarantee compliance with regulatory frameworks

DNS enforcement reduces risk but does not eliminate it.

7. Payments, Fix Plan & Monitoring Subscription

Payments are processed via Stripe.

Fix Plan

The Fix Plan is a one-time purchase.

Upon purchase:

  • A 14-day Monitoring trial is automatically activated.
  • After 14 days, unless canceled in the customer portal, a recurring subscription of $29 USD per month will automatically begin.
  • By purchasing the Fix Plan, you authorize this automatic transition to subscription billing.

You may cancel the subscription before the end of the trial period to avoid charges.

Subscriptions renew automatically until canceled.

8. Refund Policy

All payments are final and non-refundable unless required by applicable law.

Refunds may be granted at our sole discretion in exceptional circumstances.

No refunds will be issued for:

  • Failure to achieve specific deliverability outcomes
  • DNS misconfiguration performed by the user
  • Third-party infrastructure failures
  • Dissatisfaction with advisory recommendations

Where mandatory consumer protection laws apply, statutory rights remain unaffected.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

The Provider shall not be liable for:

  • Direct damages
  • Indirect damages
  • Consequential damages
  • Lost profits
  • Lost revenue
  • Loss of business
  • Data loss
  • Security breaches by third parties

Total liability shall not exceed the total amount paid by you in the preceding 12 months.

10. Third-Party Services

The Service relies on third-party providers including:

  • Vercel (hosting)
  • Supabase (data storage)
  • Stripe (payments)
  • Zoho (email services)
  • Resend (email delivery)

We are not responsible for downtime, outages, or failures caused by these providers.

11. Indemnification

You agree to indemnify and hold the Provider harmless from claims arising from:

  • DNS changes you implement
  • Email campaigns you conduct
  • Misuse of the Service
  • Regulatory violations
  • Third-party disputes

12. Intellectual Property

All scoring systems, algorithms, monitoring logic, and branding remain the property of EnforceLayer.

Unauthorized reproduction or resale is prohibited.

13. Termination

We may suspend or terminate access for:

  • Abuse
  • Security risk
  • Violation of these Terms

Termination does not remove payment obligations incurred prior to cancellation.

14. Governing Law

These Terms are governed by the laws of the Czech Republic.

Any disputes shall be resolved by competent courts in the Czech Republic.

Where mandatory consumer protection laws apply, those rights remain unaffected.

15. Changes to Terms

We may update these Terms at any time.

Continued use of the Service constitutes acceptance of updated Terms.
